KEARNEY — A rural Ravenna man faces as many as five years in prison for firing a gun at his wife.
Randy Miller Jr., 27, pleaded no contest earlier this week in Buffalo County District Court to one count of felony terroristic threats against his now-estranged wife. In exchange for his plea, a count of using a weapon, a .22-caliber pistol, to commit a felony was dismissed.
The Buffalo County Attorney’s Office also agreed to recommend probation for Miller at sentencing. However, Judge Bill Wright doesn’t have to follow that agreement.
Wright ordered Miller to undergo a presentence investigation to be conducted by the state probation department. Those findings will be sent to the judge to use in sentencing.
Sentencing will be in January.
On Aug. 22, Miller and his wife argued outside their home six miles southwest of Ravenna on Poole Road. Miller’s wife told Miller she was moving out.
As Miller’s wife was gathering some belongings, Miller went into the bedroom with the pistol, first holding the gun to his head, then pointing it at his wife.
He told her to get out of the house. Miller then fired a shot into the wall of the room about two feet from his wife.
A short time later, a Buffalo County deputy sheriff arrived, and Miller was arrested without incident. The pistol was confiscated.
A bullet hole was found in the wall.
Court records indicate Miller’s estranged wife has an active protection order against him. The couple also has a divorce pending in district court.
