INSTRUCTIONS TO BIDDERS

INVITATION

1.01 BID SUBMISSION

A. Bids signed and under seal,

executed, dated, and submitted for

the furnishing of all labor, materials,

and equipment for the Central

Community College - Hastings,

Kearney Building - Welding Re-

model prior to:

1. Date: January 3, 2019.

2. Time: 2:00 p.m.

3. Place: Central Community Col-

lege Board Room

4. Location: Grand Island, Ne-

braska.

B. Offers will be opened publicly

immediately after the time for re-

ceipt of bids. The Owner will con-

sider the bids received for the fur-

nishing of said labor, materials and

equipment necessary for the proper

construction of the aforesaid proj-

ect.

C. The General, Mechanical and

Electrical, will be under one Bid. All

subcontractor quotations shall be

sent to the General Contractor.

D. Bid Security is required to be

submitted with bid proposal form.

Make payable to Central Commu-

nity College in the amount of 5% of

the Lump Sum Bid Amount. Bid

Security shall be of cashier's

check, certified check, or Bid Bond

issued by a Surety licensed to con-

duct business in the State of Ne-

braska. Form of Bid Bond is AIA

Document A310. Any agent signing

a bid bond on behalf of the Surety

must attach a Power of Attorney ef-

fectively evidencing the agent's au-

thority to bind the Surety to the

performance of the Bid Bond.

E. Performance Bond: The Con-

tractor shall be required to furnish

acceptable bonds to complete the

work and pay for all labor and ma-

terials used, said bonds to be in the

amount of 100% of total amount of

the Contract. See Document A701,

Instructions to Bidders.

F. Taxes: The Contractor by vir-

tue of his contract with Central

Community College, becomes a

purchasing agent for the Owner on

their behalf and under Statute

77-2702 does not pay sales tax.

G. Insurance: Prior to the start of

the work, completed copies of the

Certificate of Insurance, AIA Docu-

ment G705 shall be submitted to

the Owner and Architect.

H. Pre-Bid Conference is man-

datory for General Contractors.

Meeting attendance is strongly rec-

ommended for major subcontrac-

tors.

F. The work consists of an inte-

rior remodel at the existing Kearney

Building on the Central Community

College - Hastings Campus to tem-

porarily relocate the welding pro-

gram. Remodel is minimal in scope

and approximately 5,000 sq. ft.

Project includes minor demolition,

including material that will need to

be removed by a licensed abate-

ment contractor under the General

Contract. New construction in-

cludes an overhead coiling door,

wood dock, interior walls, hollow

metal frames and doors, piping,

minimal mechanical equipment,

and electrical work.

1.03 CONTRACT DESCRIPTION

A. Contract Type: A single prime

contract based on a Stipulated

Price as described in Document 00

5200 - Agreement Form.

B. Project will be constructed un-

der one general construction con-

tract.

1.04 OWNER OCCUPANCY

A. Owner intends to occupy the

Project upon Substantial Comple-

tion.

B. Schedule the Work to accom-

modate Owner occupancy.

1.05 CONTRACT TIME

A. The bidder, in submitting an

offer, accepts the Contract Time

period stated for performing the

Work. The completion date in the

Agreement shall be the Contract

Time added to the commencement

date.

1.06 WORK SEQUENCE

A. ALL WORK MUST BE COM-

PLETED WITHIN THE SCHEDULE

2.04 PRODUCT/

ASSEMBLY/SYSTEM

SUBSTITUTIONS

A. No technical questions will

be answered by the Architect's/-

Engineer's office(s) during the

twenty-four (24) hours immedi-

ately preceding the bid opening

time and date.

B. All products and manufactur-

ers shall be as specified in the bid

documents. Any requested

changes in products or manufac-

turers shall be submitted to the Ar-

chitect seven days prior to the bid

date. Requested changes that have

been approved will be included in

an addendum. Any requested

changes not included in an adden-

dum are to be considered as not

approved. The Owner reserves the

right to negotiate any proposed

Voluntary Alternates only with the

apparent low bidder with selection

based on the Base Bid and se-

lected Alternate(s).

C. The Architect does not intend

to issue any addenda to the bidd-

ing documents within three (3)

working days of the bid opening

time and date.

SITE ASSESSMENT

3.01SITE EXAMINATION

A. All Bidders are required to

make a careful, close examination

of the entire building areas before

submitting a bid. See 01 1000

Summary for the schedule.

1.4 CONTRACTOR USE OF SITE

AND PREMISES

A. Arrange use of site and prem-

ises to allow:

1. Owner occupancy.

2. Use of site and premises by

the public.

B. Provide access to and from

site as required by law and by

Owner:

1. Emergency Building Exits Dur-

ing Construction: Keep all exits re-

quired by code open during con-

struction period; provide temporary

exit signs if exit routes are tempo-

rarily altered.

2. Do not obstruct roadways,

sidewalks, or other public ways

without permit.

C. Utility Outages and Shutdown:

1. Limit disruption of utility ser-

vices to hours the building is un-

occupied.

2. Do not disrupt or shut down

life safety systems, including but

not limited to fire sprinklers and fire

alarm system, without 7 days' no-

tice to Owner and authorities hav-

ing jurisdiction.

3. Prevent accidental disruption

of utility services to other facilities.

OFFER ACCEPTANCE/

REJECTION

4.01 DURATION OF OFFER

A. Bids shall remain open to ac-

ceptance and shall be irrevocable

for a period of thirty (30) days after

the bid closing date.

4.02 ACCEPTANCE OF OFFER

A. The Owner and Contractor

shall have the right to reject any or

all bids, which are in any way in-

complete or irregular, and to waive

any informality in any proposal.

OF COMMISSIONERS

EMERGENCY MEETING

DECEMBER 3, 2018

 

An Emergency meeting of the

Buffalo County Board of Commis-

sioners was held on Monday, De-

cember 3, 2018 at 4:00 P.M. Chair-

man McMullen called the meeting

to order and led those present in

the Pledge of Allegiance. The fol-

lowing Board members responded

to roll call: Joseph Brayton, Kent

Greder, Ivan Klein, Ronald

Loffelholz, Sherry Morrow, Dennis

Reiter and William McMullen.

Chairman McMullen announced

that in accordance with Section

84-1412 of the Nebraska Revised

Statutes, a current copy of the

Open Meetings Act is available for

review and posted at the back of

the Board Room.

Notice of the meeting was given

to all members of the Board of

Commissioners via telephone.

County Clerk Janice Giffin took all

proceedings hereinafter shown

while said meeting was open to the

public. A copy of the acknowledg-

ment and receipt of notice and

agenda by the Board of Commis-

sioners is attached to these min-

utes. Deputy County Attorney Kari

Fisk and County Assessor Ethel

Skinner were present.

Chairman McMullen stated that

the meeting was called as an emer-

gency for discussion of closing the

County Offices on December 5,

2018 for the National Day of

Mourning to honor former Pres-

ident George H.W. Bush. Deputy

County Attorney Fisk provided two

draft resolutions for their consider-

ation and or modification.

Moved by Brayton and seconded

by Reiter not to close the County

offices on December 5, 2018 but to

encourage all employees to re-

member former President George

H. W. Bush by observing a moment

of silence in his honor at noon

when the funeral service is sched-

uled to commence. Upon roll call

vote, the following Board members

voted "Aye": Brayton, Reiter, and

Loeffelholz. Voting "Nay": Greder,

Klein, Morrow and McMullen. Mo-

tion declared failed.

Moved by Greder and seconded

by Morrow to close the County of-

fices on December 5, 2018 for Na-

tional Day of Mourning to honor

former President George H. W.

Bush with the following Resolution

2018-53. Upon roll call vote, the

following Board members voted

"Aye": Greder, Morrow, Klein and

McMullen. Voting "Nay": Brayton,

Loeffelholz and Reiter. Motion de-

clared carried.

RESOLUTION 2018-53

WHEREAS,

President Donald

Trump has, by executive order, ap-

pointed Wednesday, December 5,

2018, as a National Day of Mourn-

ing to honor former President

George H.W. Bush who passed

away on Friday, November 30,

2018, and;

WHEREAS, Governor Pete Rick-

ets, in accordance with said Presi-

dential order and State law, has

provided the same benefit to State

employees, and;

WHEREAS, the Buffalo County

Board of Commissioners wishes to

join the nation in this National Day

of Mourning and wishes to aid its

employees in their observation of

the National Day of Mourning; and,

WHEREAS, complete closure of

all County functions is not possible

as the State of Nebraska has di-

rected the Court system remain

open for business and other essen-

tial county functions such as law

enforcement functions may not be

suspended;

NOW THEREFORE, BE IT RE-

SOLVED BY THE BUFFALO

COUNTY BOARD OF COMMIS-

SIONERS:

1. That Buffalo County join the

Federal and State government in

observation of Wednesday, De-

cember 5, 2018, as a National Day

of Mourning; and, as such, Decem-

ber 5, 2018 shall be declared a

County holiday.

2. As it relates only to December

5, 2018, Officials shall work

promptly to classify each employee

under their supervision as

"essential" or "nonessential". For

purposes of this resolution

"nonessential" employees shall be

those who can observe this holiday

as scheduled without disruption of

Court, law enforcement, or other

essential services and "essential"

employees shall be those who

must delay their observation of this

Day of Mourning so as to not dis-

rupt Court, law enforcement, or

other essential services. Supervi-

sors shall take reasonable efforts to

notify employees of their classifica-

tion by noon on December 4, 2018.

3. All nonessential employees

shall observe this holiday on the

date declared: December 5, 2018.

4. All essential employees shall

be issued floating holiday leave for

any hours worked on December 5,

2018, so that they may observe this

Day of Mourning on a day in the fu-

ture in accordance with county pol-

icies on floating holidays.

5. Officials may treat an em-

ployee as essential for less than the

full day and may allocate holiday

and floating holiday leave in pro-

portion to hours actually worked by

that employee.

6. Prior requests to use paid

leave on December 5, 2018, will be

amended to reflect this additional

allocation of holiday leave.
